Trial Terms

BY REGISTERING FOR A FREE TRIAL OF SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THE MOST RECENT MASTER SERVICES AGREEMENT MADE AVAILABLE BY SOCIALEDGE, INC. DBA CREATORIQ AND, AS APPLICABLE, ITS AFFILIATES (“WE”, “US”, “OUR”) AT WWW.CREATORIQ.COM/LEGAL (TOGETHER WITH THESE TRIAL TERMS, “THE TERMS”). IF YOU ARE ACCEPTING THE TERMS ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THE TERMS, IN WHICH CASE THE TERM “CUSTOMER”, “YOU” OR “YOUR” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF THE INDIVIDUAL ACCEPTING THE TERMS DOES NOT HAVE SUCH AUTHORITY, OR DOES NOT AGREE WITH THE TERMS, SUCH INDIVIDUAL MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES.

Services Provided. We shall make the applicable Service(s) available to you on a trial basis free of charge (the “Trial Services”) until the earlier of (a) the end of the free trial period for which Customer registered to use the Trial Services, or (b) the start date of any paid services purchased by Customer, or (c) termination by us in our sole discretion.

No warranties. Notwithstanding anything to the contrary in the Terms, the Trial Services are provided “as-is” without any warranty. We expressly do not represent or warrant that: (a) your use of the Trial Services will meet your requirements, (b) your use of the Trial Services will be uninterrupted, timely, secure or free from error, or (c) usage data provided during the free trial period will be accurate.

Limitation of Liability. We shall have no indemnification obligations nor liability of any type with respect to the Trial Services unless such exclusion of liability is not enforceable under applicable law, in which case our liability shall not exceed $100.00. Notwithstanding anything to the contrary in the Terms, you shall be fully liable to us for any damages arising out of your use of the Trial Services, any breach by you of the Terms, and any of your indemnification obligations in the Terms.
